YOUR FULL ACCEPTANCE OF THESE TERMS IS AN ESSENTIAL CONDITION OF OUR PROVIDING YOU ACCESS TO OUR WEBSITE, PRODUCTS, SERVICES, TRIPS, AND EXPERIENCES.

THESE TERMS CONTAIN IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MAY APPLY TO YOU. THESE TERMS ALSO REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE CERTAIN DISPUTES RATHER THAN JURY TRIALS OR CLASS ACTIONS.

By using our products or Services or placing an order for products or Services from us, you affirm that you are an end-user and are not placing an order on behalf of an organization or company not indicated on your order or contract.

Changes to These Terms

We may revise and update these Terms from time to time in our sole discretion. Changes become effective when posted unless otherwise stated.

Your continued use of the Website or Services following the posting of revised Terms means that you accept and agree to the changes. You are responsible for periodically reviewing these Terms.

REFUNDS, PAYMENTS, AND CANCELLATION POLICY

No Refund Policy

Travel With Joy LLC maintains a NO REFUND policy except where expressly stated otherwise in these Terms or required by applicable law.

By making your deposit or other payment, you confirm that you have read and agree, without exception, to these Terms.

If you fail to comply with these Terms or complete any applicable requirements, including federal, national, international, airline, Vendor, or destination requirements, your reservation may be canceled and your payments forfeited.

If you voluntarily cancel a trip or any activity associated with a trip, including tours, excursions, accommodations, transportation, or other components, your payments will be forfeited and no refund will be issued except as expressly provided by Travel With Joy in writing or required by law.

If you decide not to participate in certain portions of a trip or use certain goods or Services included in your package, no refund will be issued for unused portions.

Travel insurance is strongly recommended to help protect your financial investment from qualifying unforeseen circumstances.

Final Payment Requirement

TOTAL BALANCE DUE, INCLUDING ALL INSTALLMENT PAYMENTS, FEES, ADD-ONS, OCCUPANCY ADJUSTMENTS, AND OTHER AMOUNTS OWED, MUST BE RECEIVED NO LATER THAN THE FINAL PAYMENT DEADLINE ESTABLISHED FOR YOUR RESERVATION.

Unless a different deadline is expressly stated for a particular trip, all balances must be paid in full no less than fifteen (15) days prior to the trip start date.

If you or any participant accompanying you has an outstanding balance after the applicable final payment deadline, the affected participant may not be permitted to participate in the trip, and the reservation may be canceled in accordance with these Terms.

ACTIVE PAYMENT METHOD & AUTOMATIC PAYMENT REQUIREMENT

Active Debit or Credit Card Required

As a condition of booking and maintaining any trip, vacation package, group experience, or other travel arrangement coordinated by Travel With Joy LLC, each participant with an outstanding balance is required to maintain an active and valid debit or credit card on file for the duration of the payment plan and until the participant's balance has been paid in full.

Maintaining an active and valid payment method is a continuing condition of your reservation.

Mandatory Automatic Payments

Unless Travel With Joy expressly agrees otherwise in writing, ALL INSTALLMENT PAYMENT PLANS ARE ESTABLISHED USING AUTOMATIC PAYMENTS (“AUTOPAY”).

By enrolling in a payment plan, submitting your initial deposit, providing your debit or credit card information, or otherwise authorizing a payment method, you authorize Travel With Joy and/or its designated payment processor to automatically charge the payment method on file according to the payment schedule associated with your reservation.

It is your responsibility to know your scheduled payment dates and ensure sufficient funds and a valid payment method are available for each scheduled payment.

Travel With Joy is not responsible for overdraft fees, insufficient-funds fees, bank fees, card fees, or other charges assessed by your financial institution as a result of an attempted scheduled payment.

Declined, Expired, Lost, Stolen, or Invalid Cards

MAINTAINING A VALID PAYMENT METHOD IS SOLELY THE PARTICIPANT'S RESPONSIBILITY.

If the debit or credit card associated with your reservation:

  • is declined;

  • expires;

  • is lost or stolen;

  • is frozen or locked;

  • is canceled or closed;

  • is replaced by your financial institution;

  • has insufficient available funds;

  • has its card number, expiration date, or security information changed;

  • becomes compromised or otherwise unavailable; or

  • cannot be successfully charged for any other reason,

YOU ARE RESPONSIBLE FOR PROMPTLY REPLACING OR UPDATING THE PAYMENT METHOD ASSOCIATED WITH YOUR RESERVATION.

Travel With Joy may provide courtesy notifications regarding declined or unsuccessful payments. However, failure to receive a reminder, email, text message, payment notification, or other communication from Travel With Joy does not relieve you of your responsibility to maintain an active payment method and remain current on your payment schedule.

15-Day Payment Method Replacement and Cure Requirement

If your payment method becomes invalid, inactive, declined, expired, lost, stolen, canceled, or otherwise unusable, you will have fifteen (15) calendar days from the date of the first unsuccessful scheduled payment or notice that the payment method is no longer valid, whichever occurs first, to provide an active replacement payment method and bring all outstanding scheduled payments current.

IF AN ACTIVE REPLACEMENT PAYMENT METHOD IS NOT PROVIDED AND ALL PAST-DUE PAYMENTS ARE NOT BROUGHT CURRENT WITHIN THE FIFTEEN (15)-CALENDAR-DAY PERIOD, TRAVEL WITH JOY RESERVES THE RIGHT TO AUTOMATICALLY CANCEL YOUR RESERVATION WITHOUT ADDITIONAL NOTICE.

Upon cancellation for failure to maintain an active payment method:

ALL PAYMENTS PREVIOUSLY MADE TOWARD THE RESERVATION WILL BE FORFEITED AND ARE NON-REFUNDABLE, EXCEPT TO THE EXTENT OTHERWISE REQUIRED BY APPLICABLE LAW.

Any forfeited deposits, installments, administrative fees, planning fees, or other payments may not be transferred, credited, or applied toward another traveler, reservation, future trip, Travel With Joy experience, service, or travel credit.

Cancellation of a reservation under this provision does not create a right to a refund, reimbursement, transfer, or future travel credit.

Participant Responsibility for Payment Information

By booking with Travel With Joy, you acknowledge and agree that monitoring your payment method, expiration date, account status, available funds, and scheduled payments is your responsibility.

A lost card, stolen card, expired card, replacement card, changed card number, compromised account, insufficient funds, banking issue, card lock, or failure to update your payment information does not automatically constitute grounds for an extension, refund, transfer, travel credit, or exception to Travel With Joy's payment and cancellation policies.

By submitting your deposit and/or enrolling in a payment plan, you expressly acknowledge and agree to this Active Payment Method & Automatic Payment Requirement.

ELECTRONIC PAYMENT AUTHORIZATION

By choosing a debit or credit card or ACH as your method of payment, as applicable, you agree that you have read, understand, and agree to these Terms.

By choosing a debit or credit card or ACH as your method of payment, you authorize Travel With Joy LLC and/or its authorized payment processor to initiate applicable payment transactions in the amounts and according to the frequency designated in your payment plan.

When participating in an AutoPay installment plan, this authorization remains in effect for scheduled payments associated with your reservation until your balance has been satisfied, your reservation is canceled, or the authorization otherwise terminates in accordance with applicable law and these Terms.

You consent to any applicable fees or costs associated with declined payments to the extent disclosed and permitted by applicable law.

CHARGEBACKS AND DEFAULTED PAYMENTS

You agree to reimburse us for collection and/or legal fees and expenses arising from lateness or default in payment to the extent permitted by applicable law.

You understand that your obligation to pay legitimate charges associated with your reservation remains subject to these Terms and applicable law.

Initiating a payment dispute or chargeback does not, by itself, cancel your reservation or constitute an approved cancellation request.

If a payment reversal or chargeback is initiated by you or on your behalf and Travel With Joy is not reimbursed for amounts legitimately owed within ten (10) calendar days following notice, Travel With Joy reserves the right to pursue available collection or legal remedies.

If Travel With Joy determines that a participant knowingly filed a fraudulent or materially false payment dispute, we reserve the right to refuse future Services to that participant to the extent permitted by law.

We reserve the right to use information reasonably necessary to collect legitimate outstanding balances and enforce our contractual rights in accordance with applicable privacy and consumer-protection laws.

The terms in this section shall survive termination of the Agreement to the extent permitted by law.

TRAVEL INSURANCE

Travel With Joy does not provide travel insurance unless specifically stated otherwise.

We strongly recommend purchasing comprehensive travel insurance, including trip cancellation, interruption, medical, baggage, and, where available and appropriate, “Cancel for Any Reason” coverage.

If you decline insurance coverage, you personally assume responsibility for financial losses associated with your travel arrangements that are not otherwise refundable under these Terms.

Because certain travel insurance benefits must be purchased within a specified period after your initial trip payment, you are encouraged to research and purchase appropriate coverage as soon as possible after booking.

Travel insurance and medical travel insurance may provide different protections. Participants are responsible for selecting coverage appropriate for their circumstances.

OUTSTANDING HOTEL OR ACCOMMODATION CHARGES

You are solely responsible for outstanding hotel or accommodation charges, purchases, bills, debts, gratuities, taxes, room service, spa services, minibar purchases, damages, and other personal expenses incurred by you or your guests unless specifically included in your Travel With Joy package.

Travel With Joy will not be responsible for personal expenses incurred by you, your guests, or other participants.

Should Travel With Joy incur authorized charges, debts, or liabilities on your behalf or in connection with your reservation, you authorize Travel With Joy to seek payment for those amounts in accordance with these Terms and applicable law.

CHILDREN UNDER 5 POLICY

Children under five (5) years of age are required to register for the trip just as all other participants.

A flat fee of $650 plus the cost of any additional meals and transportation, including flights, ground transportation, or sea transportation fees, whichever is greater, may be charged for each child under five.

Parents or guardians must disclose and register any children under five at the time of booking. Failure to register a child may result in additional charges or cancellation of the reservation without refund.

Travel With Joy reserves the right to decline participation if the presence of an unregistered child affects trip logistics or Vendor policies.

If a minor is eligible for a Child Discount rate for a particular trip, the age requirements established for that trip will apply. Any applicable rate adjustments resulting from the child's age at the time of travel will be the responsibility of the parent or guardian.

PARTICIPANT CHANGES TO RESERVATION

Making participant, name, or reservation-information changes after booking is prohibited without the express written permission of Travel With Joy.

If changes to your reservation are made directly with Vendors without our written permission, Travel With Joy reserves the right to cancel your reservation without refund where permitted by law and Vendor policies.

If Travel With Joy authorizes a participant, name, or information change, administrative fees will generally apply as follows:

  • 90 or more days before departure: $250 administrative fee plus applicable Vendor charges.

  • 30–90 days before departure: $450 administrative fee plus applicable Vendor charges.

  • 0–30 days before departure: Changes generally will not be permitted.

All changes remain subject to airline, hotel, cruise line, tour operator, and other Vendor policies and availability.

Any Vendor change fees are in addition to Travel With Joy administrative fees and are the responsibility of the booking participant.

AIRFARE

Unless explicitly stated on the booking page, airfare is not included in the package price.

You are responsible for providing accurate flight information when requested.

Where Travel With Joy offers a package that specifically includes airfare, flight ticketing and payment requirements may be subject to separate airline or Vendor deadlines and restrictions.

OCCUPANCY SELECTION

Travel With Joy will not automatically pair unrelated participants for double-occupancy accommodations.

If you are traveling alone, you must select the appropriate single-occupancy option unless otherwise authorized by Travel With Joy. Select double occupancy only when traveling with a confirmed companion.

If you incorrectly select double occupancy, you may be required to pay the difference between the double- and single-occupancy rate.

If your selected roommate cancels and you are unable to find another eligible roommate, your booking may be converted to single occupancy, and the applicable single-occupancy rate at the time of adjustment will apply.

You are responsible for paying any resulting difference by the deadline provided.

Failure to pay an occupancy adjustment may result in cancellation pursuant to the Refunds, Payments, and Cancellation Policy.

Payments or balances associated with a canceled roommate will not automatically be transferred to a replacement roommate. Each participant remains individually responsible for their financial obligations.

GUESTS OF PARTICIPANTS

Each primary participant is responsible for communicating trip details, disclaimers, requirements, and these Terms to guests registering in connection with their reservation.

Adult guests may be required to independently acknowledge and accept these Terms.

If a guest declines to accept applicable Terms or requirements, Travel With Joy reserves the right to refuse Services to that guest in accordance with these Terms.

CHILDREN TRAVELING WITH ONE PARENT OR NON-PARENT/GUARDIAN

Children under sixteen (16) years of age must be appropriately supervised by a parent or guardian during the trip.

Foreign border officials, airlines, cruise lines, or other authorities may require custody documents or written consent from one or both parents for minors traveling with one parent, someone who is not their parent or legal guardian, or as part of a group.

It is your responsibility to obtain, safeguard, and provide all documentation required for minors traveling with you.

COMMUNICATIONS AND TIMELY COMPLETION OF REQUESTS

Travel With Joy will communicate primarily through email and other designated official communication channels.

IT IS YOUR RESPONSIBILITY TO MONITOR YOUR EMAIL, INCLUDING SPAM AND JUNK FOLDERS, FOR ANNOUNCEMENTS, PAYMENT NOTICES, TRAVEL UPDATES, DOCUMENT REQUESTS, AND OTHER IMPORTANT COMMUNICATIONS.

Participants may be required to submit information or documentation related to their trip within specified deadlines.

Failure to timely submit requested information may result in fees, missed reservations, Vendor penalties, inability to participate, or cancellation.

You are solely responsible for consequences resulting from your failure to timely provide requested information or documentation.

PASSPORTS

U.S. citizens traveling internationally generally must present a valid U.S. passport and comply with the entry requirements of the destination country.

Many destinations require passports to remain valid for a specified period beyond the traveler's return date.

All names on reservations, tickets, identification, passports, visas, and other travel documents must match as required by the applicable Vendor and governmental authority.

It is solely your responsibility to determine and obtain all documentation required for your trip.

Failure to obtain required travel documentation does not entitle you to a refund from Travel With Joy.

VISAS

Some destinations require travelers to obtain visas or other travel authorizations before arrival.

It is solely your responsibility to determine whether visas or travel authorizations are required based on your citizenship, itinerary, and destination.

Failure to obtain a required visa or authorization may result in denied boarding or entry and does not entitle you to a refund from Travel With Joy.

VACCINATIONS AND HEALTH REQUIREMENTS

Destinations, Vendors, airlines, cruise lines, or governmental authorities may establish health, vaccination, testing, or other entry requirements.

You are responsible for determining and complying with all requirements applicable to your itinerary.

Failure to comply may result in denied boarding, denied entry, quarantine, additional expenses, or other consequences.

Travel With Joy is not responsible for losses resulting from your failure to satisfy applicable health or entry requirements.

VENDOR AND OTHER THIRD-PARTY SERVICES

Travel With Joy offers travel-planning and coordination Services involving separate and independent Vendors.

Travel With Joy does not own, operate, manage, or control independent airlines, hotels, resorts, cruise lines, transportation companies, restaurants, tour operators, excursion providers, or other third-party Vendors unless expressly stated otherwise.

Travel With Joy acts as an intermediary in arranging transportation, accommodations, sightseeing, excursions, and other Services provided by independent Vendors.

To the extent permitted by law, Travel With Joy is not responsible for the acts, omissions, negligence, defaults, delays, cancellations, or other conduct of independent Vendors.

Vendor information presented by Travel With Joy is believed to be accurate when published but may change without notice.

ITINERARY MODIFICATIONS, SUBSTITUTIONS, AND CANCELLATIONS

Travel With Joy will make reasonable efforts to maintain published itineraries. However, itineraries may be modified due to availability, weather, Vendor changes, transportation issues, safety considerations, circumstances beyond our control, or other operational needs.

Travel With Joy reserves the right to substitute comparable accommodations, transportation, activities, guides, or other trip components when reasonably necessary.

If a specific trip, tour, or activity is canceled by Travel With Joy or an applicable Vendor, any refund or credit will be subject to amounts actually recoverable from the Vendor and applicable contractual obligations, except where otherwise required by law.

FORCE MAJEURE

Travel With Joy assumes no responsibility for loss, accident, delay, inconvenience, itinerary disruption, or other consequences resulting from circumstances beyond our reasonable control.

Such circumstances may include acts of God, natural disasters, severe weather, pandemics, epidemics, governmental actions, border closures, war, terrorism, civil unrest, strikes, transportation interruptions, Vendor failures, or similar events.

Travel With Joy does not guarantee the financial condition, operational status, safety conditions, health conditions, weather, or political stability of any destination or Vendor.

MEDICAL SAFETY, RISKS, AND PROXY

Participants are responsible for determining whether they are medically and physically capable of participating in a trip and its activities.

Any disability or condition requiring special accommodation should be disclosed when reasonably necessary to allow Travel With Joy to determine whether the requested assistance can be provided.

Travel With Joy and its Vendors may be unable to provide individual physical assistance with walking, dining, boarding vehicles, or other activities.

Travel inherently involves risks. Participants should exercise reasonable caution and assess whether activities are appropriate for their individual abilities.

Healthcare standards and availability outside your home area may differ significantly.

In an emergency where you are unable to authorize your own medical care, you authorize Travel With Joy, its representatives, Vendors, or agents to seek reasonable emergency assistance on your behalf when necessary. You remain responsible for resulting medical and related expenses.

ASSUMPTION OF RISKS

You understand that travel and participation in certain activities may involve inherent risks, including accidents, illness, injury, transportation disruptions, wildlife encounters, environmental hazards, criminal activity, political instability, limited access to medical care, and other risks.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU VOLUNTARILY ASSUME THE RISKS INHERENT IN YOUR TRAVEL AND PARTICIPATION IN ACTIVITIES AND AGREE THAT TRAVEL WITH JOY SHALL NOT BE LIABLE FOR LOSSES CAUSED BY RISKS OUTSIDE ITS REASONABLE CONTROL OR BY INDEPENDENT THIRD-PARTY VENDORS, EXCEPT WHERE SUCH LIABILITY CANNOT LAWFULLY BE WAIVED.

INDEMNIFICATION AND LIMITATION OF LIABILITY

To the fullest extent permitted by law, you agree to indemnify and hold harmless Travel With Joy LLC and its officers, employees, contractors, suppliers, and agents from losses resulting from your negligence, violation of applicable law, or material violation of these Terms.

To the fullest extent permitted by law, Travel With Joy will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from circumstances outside its reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

CODE OF CONDUCT

Participants are responsible for following the reasonable directions of Travel With Joy representatives, tour guides, Vendors, and applicable laws and regulations.

Travel With Joy may remove a participant from all or part of a trip if their conduct is threatening, dangerous, harassing, abusive, discriminatory, disruptive, illegal, or materially interferes with the experience or safety of others.

Participants engaging in criminal conduct, harassment, verbal or physical abuse, unwanted sexual advances, or other serious misconduct may be removed from the trip.

NO REFUND WILL BE ISSUED FOR UNUSED TRIP COMPONENTS WHEN A PARTICIPANT IS REMOVED DUE TO THEIR OWN PROHIBITED CONDUCT, EXCEPT WHERE OTHERWISE REQUIRED BY LAW.

Participants come from a variety of backgrounds and beliefs. Travel With Joy expects participants to treat one another with dignity and respect.

Using a Travel With Joy trip to market or promote an outside individual, organization, group, product, or business without prior authorization is prohibited.

UNAUTHORIZED RECORDINGS POLICY

Participants may not intentionally make audio or visual recordings of another participant in circumstances where that person has a reasonable expectation of privacy without appropriate consent.

Participants should respect requests from others not to be photographed or recorded where reasonably possible.

Serious violations may result in disciplinary action, including removal from an activity or trip.

COMPANY USE OF YOUR LIKENESS

Where applicable and subject to any separate media release or consent process provided by Travel With Joy, participants may authorize Travel With Joy to use photographs, video, audio, or other recordings captured during Travel With Joy experiences for lawful promotional, marketing, advertising, and business purposes.

Where Travel With Joy provides a separate Image & Media Release Form, the terms of that release will govern Travel With Joy's intentional commercial use of a participant's likeness.

Participants understand that other travelers may independently capture photographs or recordings during group travel, and Travel With Joy cannot control all third-party personal recordings.

ASSIGNMENT OF RIGHTS

Travel With Joy reserves the right to assign its rights or delegate its duties under these Terms to the extent permitted by law.

Participants may not assign, transfer, or delegate their reservation or contractual rights to another person without Travel With Joy's prior written consent.

CONFLICTS AND ORDER OF PRECEDENCE

If there is a conflict between these Terms and another agreement between you and Travel With Joy, the more specific written agreement applicable to the particular transaction may control where expressly stated.

If any provision of these Terms conflicts with applicable law, that provision shall be limited or modified only to the extent necessary to comply with the law, while the remaining provisions remain in effect.

PARTICIPANT CHANGES TO TERMS

No alteration, cancellation, variation, or addition to these Terms proposed by a participant will be effective unless expressly agreed to in writing by an authorized representative of Travel With Joy LLC.

DISPUTE RESOLUTION AND BINDING ARBITRATION

YOU MAY BE GIVING UP CERTAIN RIGHTS TO LITIGATE CLAIMS IN COURT, HAVE CLAIMS DECIDED BY A JURY, OR PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION TO THE EXTENT THIS ARBITRATION AGREEMENT IS VALID AND ENFORCEABLE UNDER APPLICABLE LAW.

Except where prohibited by law or where another remedy is expressly provided in these Terms, disputes arising from or relating to these Terms, Travel With Joy Services, or the parties' contractual relationship may be submitted to binding arbitration.

For disputes subject to arbitration, the parties agree that arbitration will be conducted on an individual basis and not as a class or representative proceeding, to the extent permitted by applicable law.

The arbitrator shall have authority to determine issues within the scope of the arbitration agreement, subject to applicable law.

Where electronic arbitration proceedings are permitted, the parties agree that hearings may be conducted by secure videoconference.

Missouri law shall govern these Terms to the extent applicable and without regard to conflict-of-law principles, except where federal law or another applicable law controls.

If arbitration is determined to be unavailable, invalid, or unenforceable for a particular dispute, the parties agree that any permitted litigation shall be brought in an appropriate court with jurisdiction in the State of Missouri unless applicable law requires otherwise.

Nothing in these Terms prevents either party from seeking temporary or emergency injunctive relief from a court with appropriate jurisdiction when legally available.

The provisions of this section intended by their nature to survive termination shall survive termination of this Agreement.
